HC directs MKU to remove Syndicate member Dr.S.Pushparaj from MKU College investigation committee

MADURAI: The Madurai Bench of Madras High Court has directed the Madurai Kamaraj University (MKU) Syndicate to include some other person, and quashed the inclusion of Syndicate member Dr.S.Pushparaj as convener in the MKU enquiry committee that is investigating into alleged attack and assault incident after an argument that took place in MKU College campus in Madurai Independence Day- August 15th 2023.

The petitioner is MKU College associate professor P.Kabilan who filed a writ petition praying to the Court to quash the MKU Syndicate Committee decision, and nominate a suitable person in the place of Dr.S.Pushparaj- Convener of the Enquiry Committee. For the petitioner, the advocate who argued was Mr.M.Ponniah. The case was alleged assault on MUTA president A.T.Senthamarai Kannan who also works in the same MKU College in Madurai.

“The only grievance of the petitioner P.Kabilan who is serving as an Associate Professor in the Madurai Kamaraj University-Tallakulam, Madurai, is that one Dr.S.Pushparaj has been accommodated in the Enquiry Committee as convener which has been constituted for the purpose of conducting a departmental enquiry against the petitioner. The said departmental enquiry has been initiated at the instance of a complaint dated 16th August 2023 made by MUTA president and MKU-ASA. An enquiry committee consisting of three members including Dr.S.Pushparaj as convenor has been constituted by the MKU to conduct an enquiry against the petitioner. The said Dr.S.Pushparaj is serving as MUFA secretary and hence the petitioner apprehends a biased enquiry, seeking to quash the order of MKU Syndicate committee dated 18-08-2023. This Court quashes….inclusion of Dr.S.Pushparaj as member in that committee, and consequently I direct the MKU Syndicate to include some other person who do not hold any official position in MUFA or MUTA, in the said enquiry committee, thereby ensuring fair enquiry against the petitioner,” the HC order said- by L.Victoria Gowri.J.
